Hey Alito! Roe Isn’t Divisive, Overturning It Is
Roe was decided in 1973. It was a 7 to 2 decision. 5 Republicans and 2 Democrats made up the majority. That’s how much the country has changed. The court found that abortion was a privacy issue and that the decision must be left to a woman to decide on her own about or not to terminate an unwanted pregnancy (with logical restricitions.) Casey v Planned Parenthood was decided in 1993 and was about women and minors having to ask for permission to get an abortion from their husbands and parents. Alito’s leaked opinion addressed both. He’s so happy to have Trump’s justices on the bench with him. Before they came along he was the only far-right anti-abortion extremist on the court (Clarence Thomas may be anti-abortion, but he’s so lazy he won’t go out of his way to batter women and children — they have to come to him.) That opinion was probably written 16 years ago and has been sitting in a file cabinet waiting until the day that Republican Jesus answered his prayer. Then a miracle happened! Trump was “elected.”
Minutes after the Supreme Court decision was leaked, barricades went up around the Supreme Court.
People took to the streets in major cities around the country — all ages, colors, genders. The attorney general of New York, Tish James spoke at Foley Square and told the crowd that New York was an access state and will remain that way. She spoke about her own abortion and said that she isn’t going to let Alito dictate her future.
Senator Elizabeth Warren was furious. Trembling furious. She’s old enough to remember what life was like before Roe v Wade and said there is no way we’re going back to that. She reminded people that Congress has the power to fix it but only if more Democrats are elected. She blamed the attack on women on Republicans and said that minority and poor women will be hit the hardest. “Republicans have been working towards this day for decades!”
The Supreme Court appealing a constitutional right has never happened before.
Nancy Pelosi and Chuck Schumer issued a joint statement. In it they said, “Several of these conservative Justices, who are in no way accountable to the American people, have lied to the US Senate, ripped up the Constitution and defiled both precedent and the Supreme Court’s reputation.”
Chuck Schumer is going to hold a vote on passing a law to protect a woman’s right to abortion which will put every one of the Republicans on the spot. He doesn’t expect it to pass because like the Supreme Court, the conservative minority has control. But it would at least get everyone on record for where each stands on a woman having control over her own body as a constitutional right.
Republicans are mad, too. Not about what Alito said in his opinion, but about the leak. Mitch McConnell did his own press conference and told people not to pay any attention to what was in Alito’s opinion but to be more concerned with the fact that it was leaked.
Justice Roberts called the leak a betrayal. Betrayal of who?
Justice Alito justifies his opinion by saying abortion isn’t anywhere in the Constitution. Neither is maximum number of justices or the filibuster. If more Democrats are elected, they could expand the court so the Federalist Society loses its power and get rid of the filibuster so they can pass laws for a change.
Alito wrote that abortion is divisive. No it’s not. 70% of the country is in favor of protecting Roe v Wade. Reversing Roe is divisive.
It’s a small, loud, dangerous minority that makes Roe seem divisive. In the past 50 years, here is what the so called pro-lifers have done to keep doctors from performing abortions:
11 murders
26 attempted murders
4 kidnappings
42 bombings
100 acid attacks
189 arsons
25,000+ phone harassment and hate mail
This small group of violent pro-lifers are terrorists but they get a pass because the First Amendment shields them while they throw fire bombs.
Politico employees have been advised to be careful when going into elevators at work and to consider removing any personal details from social media accounts that identify them as Politico staff. The pro-lifers or Federalist Society could target them next.
A small, devious, fascist minority is in control. They didn’t get to where they are legitimately. Their aim is to destroy democracy and disempower women, minorities and members of the LGBTQ community. The Supreme Court and the GOP are directing the country back to a time where it belonged to white land owning Christian men, before the Constitution was written. The only way out of this is to vote for Democrats, even the imperfect ones.
